Cremation Regulations 2008 - Your Right To Inspect The Medical Certificates

When you now apply for a cremation you have the right to inspect the medical forms about the death of the deceased. Inspection takes place before the cremation is authorised by the Medical Referee (the doctor attached to the crematorium).

There are two medical forms. One is completed by the doctor who treated the deceased during his or her last illness, the other is completed by a doctor who has no connection with the deceased or the first doctor. The second doctor must examine the deceased and discuss with the first doctor and at least one other person the death.

If you have no problems with the cause of death, you may not wish to inspect the forms, but if you have any doubts or were surprised that the death had happened, you have the right to inspect. Inspection normally takes place at the crematorium office up to 48 hours after the forms are received there.

The Medical Referee may be able to give advice on the cause of death, and may charge a fee for this service. The inspection may also delay the funeral taking place, if there are less than three days before the cremation time.

The Ministry Of Justice reviewed the cremation regulations and the result was that 'The Cremation Regulations 2008' came into effect on 1 January 2009, enabling you to inspect these medical forms.
